Legislation

The Ministry of Defence complies with all relevant international and United Kingdom legislation, [link to EMS list of legislation] which has been listed by Enviros to support the Environmental Management System.   
Parts of some of the United Kingdom’s National Parks have a long tradition of defence use, pre-dating their designation by many years. The Ministry of Defence continues to give a high priority to conservation and remains an important contributor to the local economy and social well-being of Park communities.

While the Government accepts* these existing uses will continue into the foreseeable future, it is nevertheless committed to ensuring that new, renewed or intensified use of land in the National Parks for defence purposes should be subject to formal consultation with the National Park Authorities and Natural England and to an undertake an Environmental Assessment as appropriate, and should be tested against any provisions set out in planning policy guidance. It acknowledges however, that there can be conflicts between defence use and Park purposes, but believes these will be best resolved through co- operation with the National Park Authorities.  The defence use of National Parks makes a major contribution to the country's defence capability and provides essential facilities which could not be easily replicated elsewhere.

Crown Immunity remains in place for certain statutory nuisances under the Environmental Protection Act (EPA) 1990.  Environmental Protection Act Part III. Section 79 defines what constitutes ‘statutory nuisances’.
